Bury are to be deducted 12 points by the English Football League after the club's creditors approved a rescue plan to clear some of the Shakers' debts.

Shakers owner Steve Dale put forward a Company Voluntary Arrangement (CVA) proposal in June which would see the club's football creditors paid in full.

Unsecured creditors, including HMRC, will be paid 25% of the money owed.

A CVA qualifies as an "insolvency event" under EFL rules but the League One club have seven days to appeal.

In a statement issued on Thursday, Dale said the CVA would mean the club's "future is secured".

He said: "We have worked tirelessly to achieve the result today whilst taking a lot of flak.

"Some might say our methods were questionable but we can all pass comment with hindsight, my job was to save Bury FC and that's done. We have other hurdles but the main one is complete."

Meanwhile, CVA nominee Steven Wiseglass said the agreement "hopefully secures a brighter future" for the Shakers.

"The agreement means the club avoids going into administration or liquidation, and it provides a degree of financial certainty in that its historic debts will be dealt with," Wiseglass added.

The deduction means Bury join local rivals Bolton Wanderers in starting the season on -12 points after the Trotters went into administration in May.

Bury are due to reappear in the High Court later in July after a winding-up petition brought by HM Revenue & Customs over an unpaid tax bill was adjourned for a third time.

The Shakers are looking for new ownership after Dale put the club up for sale in April.

Bolton Wanderers' pre-season friendly away at non-league side Chester on Friday has been called off.

The news comes on the same day Bolton's players issued a statement saying they are not happy with the progress of a takeover of the League One club.

The players say they have not been paid for 20 weeks and had no communication with the club's administrator.

It is the second time the financially beleaguered club have not fulfilled a pre-season fixture in 12 months.

"We apologise for any inconvenience caused, and wish the players, supporters and staff at Bolton Wanderers the best of luck as they search for a resolution in a difficult time for their great football club," a statement released by Chester said.

Bolton's administrators have been in control of the club since May when the club appeared in the High Court over a £1.2m unpaid tax bill.

In July 2018, Bolton's pre-season friendly against St Mirren was called off after players went on strike over unpaid wages and bonuses.

The players previously refused to train for 48 hours in April in protest at staff not being paid while their league fixture against Brentford in May was called off after players refused to play until they were paid the wages they were owed.

In the players' statement, which makes no mention regarding Friday's friendly, it is said the delay in payment and protracted takeover has caused them "mental and emotional" stress.

Paul Appleton, joint administrator at the club, later said that he "shares the players' frustrations" and said they were working "tirelessly" to complete the sale of the club to the Football Ventures consortium.

He also said that the administrators had been in touch with manager Phil Parkinson, who has "continuously explained" the ongoing situation to the players.

I'd say a second, hefty points deduction is very possible as things stand ; they haven't yet been punished for the Brentford debacle and they can't now argue that it was a one off. As I understand it they don't have more than handful of players and the ones they have have not been paid for nearly five months. And we kick off a fortnight tomorrow.

It beggars belief. They are a Founder Member of the Football League. Where are the EFL in all this?

But the players have gone on strike, forcing Friday’s pre-season friendly at Chester to be called off.

EMOTIONAL STRESS

The squad blame "severe mental and emotional stress" for repeating the strike action that meant May's Championship clash with Brentford never took place.

Trotters' players found training facilities locked up when they returned for pre-season training, with the League One club now in administration amid takeover talks.

And in a joint statement today, they said: "The players and coaching staff have not been paid by the club for 20 weeks and the administrators have not offered any financial assistance.

"It is our understanding that there are sufficient funds to provide financial help immediately, but there has been none.

"As we have stated in a previous statement, all this has caused severe mental and emotional stress, affecting both our professional and personal lives, and this has now only increased.

"Certain individuals are in need of support and none has been forthcoming from the club.

"With the new season looming, it is becoming impossible to prepare correctly for the challenge ahead.

"Contracted players and staff have returned to what they hoped would be a resolved situation and a fresh start for everyone.

"They have undertaken their duties and obligations with diligence and professionalism but how long is it reasonable for us to do so without being paid?"

Sources close to the Football Ventures consortium insist a deal to buy both the club and Bolton Whites Hotel could be sealed within a matter of days.

Supporters remain understandably sceptical, having had their hopes dashed several times this summer, but those involved in negotiations maintain important progress has been made.

Football Ventures are understood to have found a new financial backer, replacing Parminder Basran, the Cheshire-based businessman who officially resigned as a director of the company last week.

That will enable them to meet the funding challenges on day one, which will include paying football creditors such as players and coaching staff.

Crucially, they have struck a deal with secured creditor, and former owner Ken Anderson, which had been one of the biggest hurdles in the process.

What damage has already been done by the delay is debatable. Wanderers were forced to cancel Tuesday’s friendly with Preston North End, leaving them with just one organised game before the big kick-off against Wycombe Wanderers on August 3.

Fans who bought tickets to the game, which was due to be played at 7.45pm at Leyland, should contact Bolton Central this morning for a refund.

The club’s seven senior players remain on strike and at least two — Josh Magennis and Erhun Oztumer - have now officially requested that their contract be torn up to enable them to sign elsewhere. Their demand to leave for free has been rejected by administrators but the PFA has been working on the players’ behalf to try and force a move.

Club sources maintain that the moment the takeover is completed, season tickets are ready to go on sale.

It is believed a dozen players have been earmarked as new signings who could come in quickly and reports claim that former Bury and Sheffield United chairman Terry Robinson could be brought in as director of football.

Robinson had a similar role at Leicester City and has also worked in Stoke City’s academy. He also acted as a consultant for Wanderers in late 2015 and early 2016, overseeing player contracts and transfers in the winter window.

if that is REALLY the EFL position, I'm baffled. Why wait until the last minute to suddenly start issuing an ultimatum? And why direct it towards the administrator, rather than FV? Unless they think the administrator is culpable in some way.....

I know football clubs often cry wolf, and BWFC are one of the worst for that. But it isn't looking good.

It's a real mess, closest I can find to an answer is that it's something to do with a £5 million loan/gift the Eddie Davies Trust gave BWFC, but for some accounting reason they had to give it direct to KA first, who then gave it to the club. (That might explain the differences between what's owed and claimed to the secured creditors) .

So many theories though, my brain just shut down after awhile.

The EFL is still awaiting details of how the terms of the CVA will be met.

If they are not provided by Thursday, the EFL board could give Bury 14 days' notice to give the required assurances or have their membership terminated.

The board could also decide to extend the deadline and give Bury more time before implementing the notice.

In a statement, the EFL said it had requested the information - which includes the "means of payment of outstanding football creditor debts" and "source and sufficiency of funding" - on several occasions.

If the Shakers do provide the relevant details by Thursday's deadline, the EFL said it will "commence negotiations with the club to enter into a membership agreement, which will incorporate the ongoing conditions for continued membership in the league and ensure the terms of the CVA are met".

BBC Radio Manchester has contacted Bury for comment.

The Shakers, promoted from League Two last season, will start in League One next season on -12 points as a CVA qualifies as an insolvency event under EFL rules.

Meanwhile, the local Safety Advisory Group (SAG) are meeting on Thursday to decide whether the club meets the requirements to safely stage fixtures at Gigg Lane next season.

The EFL has the ability to suspend the club's fixtures should the SAG confirm the club cannot provide evidence it can hold the opening fixtures of the season.

What is a Company Voluntary Arrangement?

An insolvent company can use a Company Voluntary Arrangement to pay its creditors over a fixed period and, if they agree, the company can continue to trade.

The company needs to apply for its CVA through an insolvency practitioner who, within a month of their appointment, will work out an arrangement to cover how much of the debt it can pay, as well as a payment schedule.

The creditors will then be invited to vote on the arrangement, however, the proposal must be approved by creditors who are owed at least 75% of the debt.

If 75% of creditors cannot agree on the arrangement, the company could face voluntary liquidation.

However, Bury's CVA - which will see football creditors paid in full and unsecured creditors paid 25% of the money they are owed - was eventually approved.

Their points deduction means Bury join local rivals Bolton Wanderers in also starting the season on -12 points after they entered administration in May.

Bury are due to reappear in the High Court on 31 July after a winding-up petition taken on by HM Revenue & Customs over an unpaid tax bill was adjourned in June for a third time.

The company needs to apply for its CVA through an insolvency practitioner who, within a month of their appointment, will work out an arrangement to cover how much of the debt it can pay, as well as a payment schedule.

The creditors will then be invited to vote on the arrangement, however, the proposal must be approved by creditors who are owed at least 75% of the debt.

If 75% of creditors cannot agree on the arrangement, the company could face voluntary liquidation.

However, Bury's CVA - which will see football creditors paid in full and unsecured creditors paid 25% of the money they are owed - was eventually approved.

Their points deduction means Bury join local rivals Bolton Wanderers in also starting the season on -12 points after they entered administration in May.

Bury are due to reappear in the High Court on 31 July after a winding-up petition taken on by HM Revenue & Customs over an unpaid tax bill was adjourned in June for a third time.

Bolton have been in administration since 13 May and will start the League One season with a 12-point deduction.

A protracted takeover of the club is due to be completed later this week.

"I urge all interested parties to work together to reach a successful conclusion as soon as possible with the season fast approaching," said Jevans.

"The ongoing situation at Bolton Wanderers remains a significant concern for the EFL and we will continue our efforts with the administrators to find a solution."

Her comments came as Wanderers' pre-season fixture against Oldham on Saturday was cancelled - the third friendly to be called off.

Further to the EFL’s statement issued earlier on Monday 29 July 2019, the following updates can be provided:

BOLTON WANDERERS

At its meeting today, the EFL Board was appraised of the position in regard to the outstanding information requested in respect of ongoing matters at Bolton Wanderers.

The Board has fully considered the Club’s further submissions and is satisfied that they are sufficient to meet the requirements of the League subject to the completion of formal documentation.

As a result the EFL Board has opted not to suspend their opening day fixture with Wycombe Wanderers and it will remain as originally scheduled on Saturday 3 August 2019 at 3pm.

BURY

Following continued and comprehensive discussions with the ownership at Bury and other interested parties throughout Monday, the EFL Board is not satisfied it has received the necessary evidence in regard to the outstanding information it requires that demonstrates how the Club will be funded moving forwards.

As a result of not meeting Monday’s 5pm deadline, which had been extended on two previous occasions, the EFL Board feels it has been placed in an unenviable position and, regrettably, has opted to take the reluctant decision to suspend Saturday’s opening day fixture with MK Dons under the provision of EFL Regulation 28.2.

In addition, the EFL Board, if not in possession of the necessary evidence by 12pm on Friday 2 August 2019, will make a determination as to whether to suspend Bury’s away fixture at Accrington Stanley on Saturday 10 August 2019.

As has been the case throughout this entire process, the EFL will continue to offer its full assistance to the ownership at Bury, but remains clear that while the League is here to support the Club through some extremely complex and complicated issues, the outstanding matters can only be resolved with the cooperation from the Club itself.

I've spotted the odd article about protests and the local MP kicking off.

Problems they have got are 1) Being in the shadow of two massive premier league clubs 2) Smallish fan base 3) No recent success that can generate interest 4) Nothing as organised as our BST to keep pushing the agenda.

PS Aren't the Neville family meant to be fans? You'd have thought they would use their media profiles to push this story, or is it all about Salford now?

Every credit to the chairman for that rant. I've always had a gut feeling that Bury would be the one out of them and Bolton that 'gets it' from EFL. They always come down heavier on soft targets.
