The independent tribunal, unlike the EFL, treated this without prejudice as a legal case and there was only one relevant legal precedent: Leeds and Bielsa. Legal precedents normally determine the outcomes of subsequent cases. How that so-called independent EFL panel with its Boro connections got away with replacing Saints with Boro in the play-off final, Gibbo only knows. Presumably, if we'd had the same legal team then, they wouldn't have got away with it. The time for appeal would have extended past the play-off final and the panel members with obvious Boro connections, like David Winnie, would have been replaced before he could propose replacing Saints with Boro in the final..
