I don't see any need to pay him tens of millions. Just sack him for inability to do the job and if he doesn't like it then see him in court. The payoff for terminating his contract was due to his convincing the board that he could do the job. As he patently couldn't he does not earn the payoff for failure and I think a court would see that.
