By the time of the flight being organized he was a Cardiff player, so any duty of care would attach to CCFC.
Most importantly their evidence that McKay organized the flight was tenuous and substantially based on conjecture. The Judge decided they didn't get anywhere near the threshold of required evidence. I had thought they had a good case, mainly because what they were saying about what they had, but as the case proceeded it became obvious that they had no documentary proof of their assertions and no witnesses. It was conjecture with very little meat on the bones.
Having failed to prove to a reasonable standard that McKay was involved in arranging the flight their argument for compensation fell apart. [Post edited 30 Mar 17:06]

What is baffling to me you sign a player for £15,000,000 & you allow him to make his own arrangements to fly back home. Surely you don't offer him a flight, he turns it down & you say carry on then. We are looking at this with perfect hindsight though. Loads of people fly in and out to Europe every week without incident. It’s considered a very safe way to travel. There was no reason for Cardiff City or Sala to think this would be anything other than a routine trip at the time. | |

Cardiff never had any issues working with McKay. They were so grateful for his services they gave contracts to two of his sons, neither of whom have ever proved they are good enough for non league or even the Scottish lower leagues.

Nantes and Agent made millions from Sala and the agent allegedly diverted Sala from Cardiff s flight to the shittiest cheapest plane and cash in hand pilot he could find. Think he was offered a cheapie airline flight , Easyjet or the like which CCFC would have agreed to , who financed that flight , Nantes or Cardiff is open to debate , hence the legal arguments still dragging on .
Online gossip suggest he wanted to say a last goobye to his team mates and a rushed arrangement was put in place for a Private flight , so who arranged that contract .
Again footage allegedly show him and translated wording suggest he rearlly was no happy setting foot on that plane from the start .

Furthermore there were findings McKay had no knowledge of the illegality and therefore no knowledge could be attributed to Nantes even if ( which was rejected) he was their agent for the purposes of transport as opposed to agent for the transfer itself. | | | |

Not really at least four different legal and governing bodies have ruled against Cardiff in their long-running dispute with Nantes following the death of Sala in 2019. Even Cardiff supporters think enough is enough. Meanwhile you continue with your attention seeking posts just trying to attract attention.
