Here we are 8 days after the "secret" hearing and there is very little being said, although it should be noted that Tonda Eckert has been talking a lot about his squad in the last few days, not sure if that is a good sign or a bad one

If there is legal wrangling going on and then it is decided against us, then Eckert being banned say two days before the Pompey game would not be good.

There is just nothing being said either way and I would imagine that this will not go past the end of the international break

I’m not sure what the urgency is ,what will be will be . Tonda just needs to go about his normal buisness as do the players. I don’t think the players are affected by the wait .I realise I might be in the minority here.

I think the fact that the Man City case is going through at the same time is a benefit to us and possibly why this is dragging on.

City have been legally fighting the Premier League charges for 3 years and 8 months and are going to take this all the way legally with the UAE threatening to withdraw billions from the UK.

Whereas the FA and PL are different bodies, they are closely aligned so the FA are probably thinking about how they’d be perceived in giving Tonda a harsh ban for 3 cases of spying when City may get away with a punitive ban for years of illegal transfer business.

I also think that the FA must be clearly thinking about the previous sanctions they handed out to Bielsa and how it would look if they gave Tonda a harsher punishment than they gave out to Bielsa. Plus any ban for Tonda that would necessitate Saints appointing the new manager would be a further punishment to Saints when we've already had an unjustifiably harsh penalty applied by the EFL last season running into this season.

Harsh punishments are very popular with fans of other clubs nowadays, if not the recipient. So, the disciplinary panel members will pander to popular taste and dish out the harshest penalties they can, regardless of the merits of the case.

Logically, of course, the only relevant precedent in Tonda's case, is Bielsa, as the FA rule on bringing the game into disrepute was exactly the same then. Bielsa received no punishment whatsoever and was even awarded the FIFA Fair Play Award at the end of that season. The EFL rule has already been dealt with by the EFL so that should no longer be a consideration.

If these cases were determined in true legal fashion, the legal precedent would be the most important consideration. But, quite honestly, these disciplinary panels from Sport Resolutions seem to do whatever they feel like doing and are heavily influenced by the media and popular opinion.
