What a load of tosh this Spygate suggestion is.
Section 33 of the 1972 Criminal Justice Act allows public access to private land in nearly every case. Notable exceptions being The Crown Estate and Defence Establishments.
That right of access applies up and until the owner/owners of the land asks a person/s to leave. Failure to do so then becomes a matter under Civil Law unless there is aggravated trespass.
If there is any substance in what we currently know ( and it’s a big if ) the person caught “ spying “ was asked to leave and immediately did so,thus complying with their obligations under the law.
As for the taking of photos/visual recordings P I N A C applies, Photography from a place where you have lawful access Is not a crime.
If Middlesbrough suggest that the rules of a Football Competition ( in this case The Championship ) supersedes Common Law then good luck with that.
For what it’s worth in my opinion if the allegations are true ( currently a very big if ) fault lies squarely with Middlesbrough in failing to properly secure their training facilities. |
Unfortunately the EFL are free to apply penalties according to their own rules e.g. it's not illegal to go into administration according to UK law, but the EFL are within their rights to deduct points from any club that does go into administration, or breaks their financial fair play rules etc. Acting within the law of the land is not a valid defence. What matters is whether or not they decide that we have broken the EFL's rules. Let's hope they decide the evidence isn't strong enough. | | | |

City's argument is that the PL's "associated party" rules breach UK competition law. If so, they win. But they are not just arguing that City are doing something that is legal under UK law. They are saying that the PL's rules are illegal because those rules do something that is banned by UK competition law.
Saints would need to have an equivalent argument i.e. that the EFL's "spying" rules are illegal, not because they prevent something that is otherwise legal under UK law, but because those rules do something that UK law says is illegal.
In general, it's well established that bodies such as the EFL can have rules that disallow something that is perfectly legal under UK law and have sanctions for those that break those rules e.g. going into administration. | | | |
