I was responding to a post that compared a rape.
Do you think it’s helpful to say Thomas shouldn’t have been remanded because historically a rapist wasn’t?
In your opinion do you consider someone throwing a plastic bottle at a police man who was quite possible wearing helmet , riot gear including face mask more heinous than someone who’s life will never be the same for being raped , with the high risk of an unwanted pregnancy, contracting sexual diseases or HIV , of course they’re not comparable but which one should deserve a custodial sentence and the other a suspended sentence .

Obviously not.
But I’d need a lot more information on each crime including the background of the perpetrators and sentencing guidelines to even hazard a guess on whether the judge had applied the law.
There’s also the chance I think the law is wrong but that’s a different argument.
It would also massively help if I had a law degree which I’m very conscious I haven’t when involving myself in these discussions.

But he didn’t just throw a plastic bottle, he was at the front of the demonstration, shouting abuse at the police, threw the bottle and aggressively tried to break through the police lines. It’s all on video. He pleaded Guilty to the offence of Violent Disorder which is complete when 3 or more persons who are present together use or threaten unlawful violence and the conduct of them (taken together) is such as would cause a person of reasonable firmness present at the scene to fear for his personal safety, each of the persons using or threatening unlawful violence is guilty of violent disorder.
Should Del Somerville be inside - absolutely.
Should the guy accused of rape and the sexual offences be inside- absolutely. I don’t know why he wasn’t remanded, but based on the information in the public domain it seems wrong and completely unacceptable that he’s not on remand. It’s also outrageous that his trial isn’t going to be until next August - but that’s not down to the judge, that’s an issue attributable to the previous government’s closure of 40% of the country’s courts.

There’s also some good stuff in sentencing guidelines and how rage bait headlines often deliberately misconstrue the facts.

I can't believe anyone would be so stupid to drive 100 miles to be pinching diesel in that particular location.
There's a lot I can't believe about this case. We'll have to wait and see - but potentially hear nothing further.
What is clear though is that if there was a shread of evidence of direct involvement in terrorism they wouldn't have been released.
They were in a rural area, potentially totally unaware they were so close to such a strategically important base, with easy access to tanks of agri diesel probably secured by no more than a padlock.
it's a two hour drive from London, similar crime happens in mid Wales, a two hour drive from the nearest city.
It's a more likley scenario than an Iranian attempt to start world war 3 by paying a random London based gang to make an incredibly obvious attempt to bomb a huge US airbase, being stopped by a farmers wife, because the combined UK, US and Israeli secret services missed it.

There are three routes into Whelford, I used to live nearby. One route takes you past the main entrance to the base which has always been illuminated 24 hours a day, another runs alongside the base you can see the base over the fence and the last obe takes you past a bloody great sign that says RAF Fairford.
There are about a dozen small villages nearby Whelford is probably the smallest and is closest to the base, you wouldn't turn up there by accident.

It's strange that seinf as they we're being watched so closely by the US (according to Trump) and our security forces, it took a farmer to alert the authorities about what was going on.
