If the courts had let the fact it's a high profile case sway their decision then it would make a complete mockery of the system. I'm not that shallow fella. I'll put it to you tho that if it was a female on trial for raping a footballer who says he couldn't remember, the majority of the people on here up in arms would have a totally different opinion on the matter.
All I'm doing is agreeing with judge and court of appeal that the girls past sexual experiences should have been used in this instance. If there wasn't leeway in special circumstances then there could be an instance where a girl gets hammered and has a one night stand every week for 20 weeks and then on the 21st week does it and can't remember so cries rape, the bloke could be totally innocent yet the jury wouldn't be aloud to know of her form, you obviously think that's perfectly ok but that's not a fair justice system at all. | | | |

She didn't "cry rape" either. She reported to the police that she woke up alone in a hotel room with no memory of how she got there or who with. The rest was pieced together from various sources and the CPS took the decision to prosecute. |  |

I didn't reference the case - I was replying to the post from Jango.
As an aside though, the new evidence didn't show anything of the sort as it made no reference to the events of that night. In fact, it quite specifically did not.

Well when you consider what rape actually is you can't help but be "fine" with it. It's physically impossible for a woman to commit the act.
Although it is actually possible for a woman to be tried for rape if she is found to have assisted the man in the act. But without a bloke, there can't be a rape. | |

I agree that no memory doesn't mean no consent, or at least, a genuinely held belief that she had consented.
I disagree that her getting hammered and having one night stands every weekend is important - in fact, it is absolutely irrelevant.
As for whether I am happy that a female can't be done for rape - rape is penetration without consent with a penis. I am neither happy, nor unhappy that a woman doesn't have a penis.
I am happy that a woman can be done for sexual assault. I have absolutely no doubt that women sexually assault men (or other women for that matter) at times. I have absolutely no problem with them receiving punishment and imprisonment when they do.
